We at tripbutter.com (Adeptus Traveltech Private Limited) make every effort to provide you with the finest travel services in a pleasant, friendly, and professional atmosphere at all times. Your satisfaction and safety are our utmost priority, and we strive to ensure that your journey is secure, comfortable, and free of misunderstandings between You, TripButter, and our Tour Leaders.

We believe in transparency, courtesy, innovation, and a positive approach. Our endeavour is always to resolve any concerns of our guests promptly and amicably, often going beyond legal formalities to ensure a smooth and enjoyable travel experience.

The terms & conditions ("Terms"), as stated herein and available on our website, together with the booking/registration form, brochures, or any other communication, form the basis of the agreement and understanding between you and tripbutter.com.

tripbutter.com is a service facilitator, and guests are required to comply with the policies, rules, regulations, laws, and requirements of the destinations and countries they travel to as well as the policies of the tour operator as per the concerned trip. You are kindly requested to carefully read, understand, and accept these terms before registering yourself, your family, or your friends for any of our tours as a guest / all types of user and availing our services on the website.

1. SHORT TITLE, EXTENT AND COMMENCEMENT

• The terms and conditions shall be named as tripbutter.com terms and conditions for User / Guests – [India and Global]" [For sake of convenience, the same are referred as "Said T&C" hereinafter].
• The Said T&C extend to the whole of India and International tours organized either by tripbutter.com and / or its affiliates- hereinafter referred to as "tripbutter".
• These terms and conditions shall come into effective from 9th October 2025, and shall remain in force until modified or amended at a later date.

2. DEFINITIONS AND MEANINGS THEREOF

In these terms and conditions unless the context otherwise requires:

• "Adeptus," "tripbutter.com" "we," "us," or "our" refers to Adeptus Traveltech Pvt. Ltd and our website tripbutter.com.
• 'Brochure' means Leaflets, folder, World showcase etc., brought out / published by tripbutter.com or by way of any other publication.
• 'Company / Affiliates' means Adeptus Traveltech Private Limited and also includes all its divisions and brands namely – tripbutter.com, including all and any other brands / divisions of tripbutter.com.
• "Credit Note" A credit note that can be used for booking of tours in future as per terms, in which it is not encash-able within a prescribed time.
• 'Itinerary' means a detailed plan for a journey with a list of places to visit; plan of travel, a book describing a route or routes of travel with information helpful to travellers and always subject to Force Majeure situation.
• 'First day of the Tour' shall start at any time – i.e., in the morning / afternoon / evening at the first destination depending on the mode of transport. The same shall apply in case of the last day of the tour. In other words, a 'Day' shall mean a part of the day or 24 hours or its part thereof.
• 'Force Majeure' means an event or circumstance not within the reasonable control, directly or indirectly, of tripbutter.com in its inability to perform its obligations/responsibilities regarding the tour including but not limited to war, hostilities, rebellion, epidemic, pandemic, explosion, fire, flood, earthquake, natural calamity, ionizing radiation, riot, government action, strikes, abnormal weather conditions, and unforeseen cancellation by contractors.
• 'Group Tours' mean such tours which are carried out in groups containing various individuals' families and where the services provided are similar to all the guest/s in that group.
• 'Guest/s' means the person in whose name or on whose behalf booking and/or registration is made for any of India and/or international tours organized by tripbutter.com.
• 'Independent contractor' means a person and/or organization selected by tripbutter.com to render services including transport, hotel, insurance, restaurant, sightseeing and attraction activities to the guest/s and/or to tripbutter.com.
• 'Jain food' means vegetarian food without onion and garlic. Meals will be provided as per tour schedule and may not necessarily be served on the table.
• 'Meal' means breakfast, lunch, dinner, packed foods and/or any other snacks (dry/wet) supplied.
• 'Rescheduling Charges' Rescheduling charges includes administration and operational charges incurred to conduct the tour considering tour period, number of destinations, activities, attractions etc.
• 'Tour/s' means any Indian tours - also referred as 'domestic tours' carried out within India and International Tours - also referred as 'World Tours' carried out in any foreign Country organized by Tripbutter.com.
• 'Tour Leader/Assistant' by whatever designation called such as Tour manager, Tour escort, Tour Guide etc., means a Person designated by Company to guide/assist the guest/s on tour in India and/or World Tours.
• "Traveller" or "You" or "Guests" or "User" means the person booking or using the services.
• "Tour Service Provider" or "TSP" means the independent third-party provider of travel services.
• "Working days" These are the days between and including Monday to Friday, and do not include public holidays and weekends.

3. SCOPE, APPLICABILITY AND ACCEPTANCE

These Terms govern the legal relationship between Adeptus Traveltech Private Limited ("Adeptus," "we," "us," or "our"), owner and operator of tripbutter.com ("Website"), and any registered Tour Service Provider ("TSP," "you," or "your") who lists, markets, or sells travel-related products or services via the tripButter.com platform. By registering as a TSP / User / Guest and submitting services for listing, you acknowledge that you have read, understood, and agreed to be bound by these Terms in their entirety. If you do not accept these Terms, you must not proceed with registration or offer any services through tripbutter. These terms apply to all bookings made with the Company, whether online through the Website, via mobile application, or through authorized agents.

4. GENERAL EXPLANATIONS

• Each provision/term of these Terms and Conditions shall be severable and if any provision thereof is declared invalid, illegal or unenforceable, then remaining provisions nevertheless shall have full force and effect.
• The masculine gender, shall also include feminine gender and vice versa, the singular shall include plural and vice versa and shall include grammatical variations thereof.

5. SCOPE OF ACTIVITIES UNDERTAKEN BY TRIPBUTTER.COM

tripbutter.com is a platform that offers tours and group tour from various tour operators. Tripbutter.com takes utmost care in selecting all the services and/or Independent Contractors / Tour Operators who provide their services, to make our guest/s comfortable on tour. tripbutter.com facilitates various aspects of the tour such as hotel, restaurant, airline, coach, shipping company etc. and does not have any control over operating of the same. though Tripbutter.com takes utmost care of its guest/s; Tripbutter.com shall not be held responsible for any loss, harm, injury, death, damage caused by default, omission or act of employees or management of any such agencies or Independent Contractors / Tour Operators. All the guest/s booking and / or registering for tour organized / proposed to be organized by tripbutter.com shall read, understand, abide by, strictly comply and observe all the terms and conditions laid down herein or in any / all other publications by tripbutter.com. We endeavor to update our guest/s from time to time by sending the guest/s various tour related instructions through SMS / emails / telephone/ or by any other mode of communication, solely for convenience of the guest/s. Guest/s should check mails regularly for updates sent from any tripbutter.com email id's and email from the booking representative as well as check SMS sent by tripbutter.com on their mobile registered with tripbutter.com. Guest/s are advised to visit website tripbutter.com to keep yourself updated with the terms and conditions, as tripbutter.com reserves right to change the terms and conditions at any time without prior intimation.

6. BROCHURE / WORLD SHOW CASE

All previous Brochures, letters and any other modes of circulation including Tour tariff printed and/or published by tripbutter.com shall stand cancelled on publication of Latest Brochure/website/Mobile App. Every effort is made to ensure accuracy in publication, based on the available information at the time of publication of the brochure. The maps used therein and/or letters and any other modes of circulation printed and/or published by tripbutter.com are inserted solely for convenience of guest/s and are not necessarily to scale and/or official.

If the time table, tour conditions and the situations then requires tripbutter.com to change any brochure information, without assigning any reasons, tripbutter.com reserves the right to change any brochure information including tour itinerary, tour tariff, departure date, number of nights at the destination and hotels before or after any guest makes booking and / or registration for any tour and / or after the departure of any tour. tripbutter.com shall endeavour to inform the guest/s of such changes as soon as possible. Last day of the tour shall be the last destination/country as per pre-decided/revised itinerary.

7. REGISTRATION AND APPROVAL PROCESS FOR BOOKING

To become an approved TSP on TripButter, you must complete our registration process and submit accurate, complete documentation, which may include:

• Valid business licenses and incorporation documents.
• Proof of insurance coverage is appropriate for your services.
• Any permits or authorizations legally required to operate in your service area(s).

tripbutter.com reserves the right to verify the authenticity of submitted documentation and to request additional information. Approval is at our sole discretion and may be withheld or withdrawn at any time if we determine that you do not meet our operational, quality, or compliance standards.

8. BOOKING OF THE TOUR

8.1 Booking can be made in the following manner:

• Guests / TSP Acceptance on tour registration form
• Online registration

8.2 Post such booking, Guest/s hereby acknowledges that all the guest/s who have booked the tour is well aware about the itinerary and are Medically fit to undertake the said tour. The Company reserves the right to ask the guest/s to provide written certification of his medical fitness before departure. The persons who are medically fit to undertake the said tours only shall join the said tour. The persons who are and/or who have suffered from any ailments for which they have taken medical treatment and/or have gone into check-up and/or hospitalization shall join the tour at their own risk. It is the responsibility of Guest to provide medical certificate on tour or before joining the tour if required by governing authority of the visiting place at your own cost. In case of any health emergency or health related issues while touring, the guest/s shall solely be responsible for it and to make their own arrangements on the tour for medical assistance & other expenses. Guest/s shall not expect the Tour leader to pay full time attention and/or to provide any medical treatment. The Tour Leader has responsibilities for arrangements of tour-related services for the group. tripbutter.com reserves the right to cancel/restrict/modify/amend the tour of such guest/s without assigning any reasons and no refund is applicable in such case. In case of death of guest/s, all the arrangements and advance payments for transportation of dead body including procuring the death certificate, postmortem, repatriation of dead body with all personal effects/property and insurance claims etc. shall be made by the accompanying guest/s and/or relative of the deceased. Company shall make all endeavors to extend any help but cannot guarantee the same. The entire expenses shall be borne by the accompanying guest/s or their relatives. tripbutter.com or any tour guide shall not be responsible for the same. If any of the relatives want to visit the country where the guest/s has passed away all the necessary arrangements shall be made by the said relatives only.

8.3 Persons, friends or relatives of the guest/s, who have not booked the tour shall not be allowed in hotel rooms, restaurants, coaches and sight-seeing places or for any activity on the tour.

9. INSURANCE

Guest/s are advised and recommended to acquire adequate Insurance Policy and Overseas Travel Insurance cover to meet expense of hospitalization, accident etc. during the tour. Tripbutter.com facilitates the travel insurance for guest/s upto the age of 70 years wherever it is mandatory and guest needs to pay differential insurance charges for age exceeding 70 years over and above the tour tariff.

It is obligatory for the guest/s to make full disclosure of medical condition to Insurance Company that may affect his ability to take up and complete the full tour. Insurance Company and /or service provider reserves the right to call for any written certification of guest/s' medical fitness before departure. tripbutter.com is insurance facilitator and is not liable/responsible for any reason whatsoever, for settlement of insurance claims and it is a matter solely between the concerned insurance company and the guest/s. Guest/s is/are advised not to carry valuables on tour and keep any valuables in cargo baggage. In case of any unfortunate event while on tour like hospitalization and/or unfortunate demise, it shall be the sole responsibility of the guest/s and/or relative of the hospitalized person/deceased to contact and submit the necessary claim to insurance authorities for further processing of the claim.

10. PRICING, PAYMENTS AND INVOICING

The registration amount paid at the time of booking is not refundable and interest free. Tour Cost in foreign currency needs to be paid before processing of VISA. Guest/s / User/s shall pay any pending balance payment sixty days prior to tour departure. The bookings shall be processed by tripbutter.com once the registration amount or the full payment as the case may be is paid. In case of billing errors, Company reserves the right to re-invoice. Guest has to pay INR.500/- (Rupees Five Hundred Only) for each instrument in case cheque dishonored by the bank. Needless to state that, the Company reserves its rights to initiate appropriate legal proceedings as for dishonor of cheques if any.

11. DOCUMENTATION

Aadhar card and Pan will be required for the purpose of booking a domestic tour. Passport, Aadhar, PAN Card and other related documents will be required for the purpose of booking any international tour. A co-traveler would also require to furnish such details. The loss of any original document is solely attributable to you, tripbutter.com is not responsible for the same on tours or otherwise.

12. CANCELLATION CHARGES

Cancellation fee charged as a percentage of total tour cost:

The aforesaid cancellation has to be communicated vide email on cancellation@tripbutter.com

13. AMENDMENTS

We reserve the right to modify these Terms at any time. Changes will be posted on the website with a revised "Last Updated" date. Continued use of our services constitutes acceptance of the amended Terms.

14. TERMINATION

tripbutter reserves the right to terminate any tour in case of any force majeure event or in case of any illegal activities including drug / substance abuse, heinous crimes, which are not permissible under the prevailing law of the land.

15. INTELLECTUAL PROPERTY & WEBSITE USE

• All intellectual property rights in the website, including text, graphics, designs, software, and trademarks, belong exclusively to the Company.
• Unauthorized use, reproduction, modification, or distribution is prohibited.
• The Customer shall not misuse the Website for fraudulent transactions, spamming, hacking, or unlawful purposes.

16. FORCE MAJEURE

The Company / tripbutter.com shall not be liable for any failure or delay in performance of its obligations arising from circumstances beyond its reasonable control including but not limited to natural disasters, epidemics and pandemics, war, strikes, terrorist activity, technical failures, or government restrictions.

17. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable consumer protection laws, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction.

18. LIMITATION OF LIABILITY

• The Company acts only as a facilitator of services and shall not be liable for deficiencies of third parties such as airlines, hotels, transport operators, restaurants, or visa authorities.
• The Company shall not be liable for:
  • Loss, damage, or delay of baggage/personal belongings,
  • Accidents, injuries, illness, or death,
  • Delays, rescheduling, or cancellation of transport,
  • Any costs arising out of Force Majeure.
• The maximum liability of the Company shall not exceed the total amount actually received from the Customer after deductions.
